The Justice Department claims it needs this information to assess whether states are complying with federal requirements to maintain accurate voter rolls, but states have mostly resisted these demands, citing state and federal privacy laws that protect Americans’ sensitive personal data. Faced with widespread pushback, the Justice Department has filed 31 federal lawsuits (so far)—against 30 states plus Washington, D.C.—seeking orders compelling these jurisdictions to turn over their data.
This tracker monitors the Justice Department’s lawsuits, providing key information for each, including the current status and key decisions as they are announced. 1 We will update this tracker regularly as new information becomes available.
To date, no court at either the district court or appellate court level has ruled in favor of the Justice Department.
On June 24, 2026, the Sixth Circuit became the first court of appeals to rule on these cases, affirming the district court's dismissal of the Justice Department's suit against Michigan. The Justice Department is seeking en banc review of the appellate panel's decision.
At the district court level, eleven federal district courts have dismissed the Justice Department's suits on the merits—the suits against California, Oregon, Michigan, Massachusetts, Rhode Island, Arizona, Wisconsin, Maine, Maryland, Pennsylvania, and New Hampshire (chronological order). Another court dismissed the suit against Georgia for filing in the wrong venue, though the Justice Department subsequently refiled in the correct district.
The Justice Department has either appealed or indicated it will appeal all eleven dismissals. Those appeals are or will be in the First, Third, Sixth, Seventh, and Ninth Circuits. So far, the Sixth Circuit's ruling in the Michigan case is the only appeal to have been resolved.
Additionally, the Justice Department has reached a settlement with one state, Oklahoma, with the state agreeing to provide its sensitive voter data in exchange for the Justice Department dismissing the lawsuit.
