Tracker: DOJ Lawsuits Seeking States' Sensitive Voter Data

As part of President Trump’s efforts to expand federal control over the country’s historically state-run election infrastructure, the U.S. Department of Justice has demanded copies of states’ complete voter registration lists, including voters’ highly sensitive data like birthdates, partial Social Security numbers, and driver’s license numbers. The Justice Department has filed federal lawsuits against 29 states (so far) and Washington, D.C., seeking orders compelling these jurisdictions to turn over their data. This tracker monitors the Justice Department’s lawsuits.

As part of President Trump’s efforts to expand federal control over the country’s historically state-run election infrastructure, the U.S. Department of Justice has demanded copies of states’ complete voter registration lists, including voters’ highly sensitive data like birthdates, partial Social Security numbers, and driver’s license numbers.

The Justice Department claims it needs this information to assess whether states are complying with federal requirements to maintain accurate voter rolls, but states have mostly resisted these demands, citing state and federal privacy laws that protect Americans’ sensitive personal data. Faced with widespread pushback, the Justice Department has filed federal lawsuits against 30 states (so far) and the District of Columbia, seeking orders compelling these jurisdictions to turn over their data.

This tracker monitors the Justice Department’s lawsuits, providing key information for each including the current status and key decisions as they are announced. 1 We will update this tracker regularly as new information becomes available.

To date, four federal courts have dismissed the Justice Department’s claims:

  • California (January 15, 2026): The district court dismissed all the Justice Department’s claims and held that the Justice Department’s demands for voter data violated federal privacy laws. Read the decision.
  • Georgia (January 23, 2026):The district court dismissed the Justice Department’s suit, finding that it should have been filed in the Northern District (Atlanta) instead of the Middle District (Macon). Read the order. Note: The Justice Department filed a new complaint against Georgia in the Northern District on January 23, 2026.
  • Oregon (January 26, 2026): The district court announced a “tentative” ruling on January 14, 2026 to dismiss the Justice Department’s claims. The court finalized this ruling on January 26, 2026 at a supplemental hearing called to address the impact on the case of U.S. Attorney General Bondi’s demand for Minnesota’s voter data as a condition for U.S. Immigration and Customs Enforcement (ICE) leaving Minnesota. Additionally, the Justice Department has reached a settlement with one state, Oklahoma, with the state agreeing to provide its sensitive voter data in exchange for the Justice Department dismissing the lawsuit.

  • 1 This tracker is limited to the U.S. Department of Justice’s lawsuits seeking state’s voter data. However, there are a few other related lawsuits. One is League of Women Voters v. Department of Homeland Security, Case no. 1:25-cv-03501 (D.D.C. Sep. 30, 2025), which alleges that the federal government’s requests for states’ voter data violates the federal Privacy Act, among other claims. Another is Common Cause v. Evnen, Case No. 25-3301 (Dist. Ct. Lancaster Cty. Sep. 22, 2025), which alleges that it would violate Nebraska law for state officials to turn over the states’ voter data.
